Memo: NYU Center on Race, Inequality and the Law Supports Constitutionalizing Fundamental Right to Education

The Center on Race, Inequality and the Law at New York University School of Law wrote a memo in June 2021 in support of constitutionalizing a fundamental right to quality public education for all children. This memo considers several viewpoints to reach a conclusion that state legislators have the power to constitutionally recognize education as a fundamental right and afford it the protection that being a fundamental right provides, guaranteeing that education is a duty of the state.
